Terms and ConditionsDetailed description of goods and/or services General Placing an item in a shopping cart without completing the purchase cycle does not: Customer privacy policy crittersandcomics.co.za shall take all reasonable steps to protect the personal information of users/ customers. For the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). The PAIA may be downloaded from: http://www.polity.org.za/html/govdocs/legislation/2000/act2.pdf Delivery policy For in-stock items delivery will be within two (2) to three (3) business days subject to receipt of payment. For out of stock items delivery will be between fourteen (14) and twenty one (21) business days. Receipt of order for delivery will be confirmed by way of e-mail which will indicate the customer order number, tracking number (if applicable) and date of expected delivery. Deliveries will be made via a courier service, during a workday, to a physical address (work or residential), and not to a post box. crittersandcomics.co.za charges a standard delivery rate of R55 for total orders up to R600. Above R600 delivery is free. For international orders please contact us for a quote on postage prior to placing the order. Average weight of items are indicated below: Estimated weight of goods: 1 Standard Comic: 100g Once you have received a tracking number you will be able to track your item by logging on to the courier’s website. Export restriction Please note that currently we only sell to South African clients Return and Refunds policy The provision of goods and services by crittersandcomics.co.za is subject to availability. In cases of unavailability, crittersandcomics.co.za will refund the client in full within 30 days. Cancellation of orders by the customer once the credit card transaction has been effected will attract a 15% administration fee. Once goods have been received by the customer no returns and/or refunds are allowed EXCEPT if crittersandcomics.co.za supplies the wrong product or if the product is in any way faulty or damaged. crittersandcomics.co.za will then exchange it for the same or correct product within 7 days of receipt by the customer. crittersandcomics.co.za will make a reasonable effort to exchange the product, but if a replacement is not possible, crittersandcomics.co.za will refund the purchase price including applicable delivery costs. Please note that in the case of incorrect products, such products must include all their original content as applicable on return. Products that have been incorrectly mailed will only be exchanged if they are still in the condition sent (sealed or unopened) – no exceptions. In the case of any returned goods that the customer claimed to be “defective” but that are found to be in working order or found to have been damaged by the receiver of those goods those customers will be held liable. All risks in the items purchased shall forthwith pass to the customer upon the conclusion of the agreement of sale. DVDs The onus is on the purchaser to ensure that any age restrictions on DVDs are observed. Regional encoding of DVDs: Please note that certain DVDs sold are Region 1 (Canada and U.S.) encoded DVDs and these products may not play in DVD players sold locally. Please make sure when purchasing a DVD from crittersandcomics.co.za that the region code (under product description) is supported by your DVD player. Payment options accepted – credit cards or bank transfer Payment may be made via Visa or MasterCard credit cards or by bank transfer into the crittersandcomics.co.za bank account. If you select to make a payment via bank transfer you will be forwarded our bank account details and your Order Reference Number to use as your reference when making the payment. Please note that an electronic transfer can take 48hrs to clear. In order to insure that payment is reflected and a quicker delivery time, please forward proof of payment (deposit or transfer) by e-mail to us at info@crittersandcomics.co.za as goods will only be shipped once proof of payment has been received. Credit card acquiring and security Credit card transactions will be acquired for crittersandcomics.co.za via PayGate (Pty) Ltd who are the approved payment gateway for Standard Bank of South Africa. PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no credit card details are stored on the website. Please forward proof of payment (deposit or transfer) by email to info@crittersandcomics.co.za. Customer details separate from card details Customer details will be stored by crittersandcomics.co.za separately from card details which are entered by the client on PayGate’s secure site. For more detail on PayGate refer to www.paygate.co.za Merchant Outlet country and transaction currency The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction Currency is South African Rand (ZAR). Responsibility crittersandcomics.co.za takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods. crittersandcomics.co.za reserves the right to refuse to accept and/or execute an order without giving any reasons. crittersandcomics.co.za also reserves the right to cancel orders in whole or in part as circumstances dictate. crittersandcomics.co.za shall only be liable to refund monies already paid by the user. All legal costs and expenses, including any collection commission, disbursements and attorney-and-client charges which we may reasonably incur in consequence of any default by the customer of any term or condition of this agreement of sale, shall whether or not any legal action or suit shall have been instituted, be payable by you to us within thirty (30) days after demand in addition and without prejudice to our right to cancel this agreement of sale. The validity, construction and enforceability of this agreement of sale shall be governed by the laws of the Republic of South Africa. No agreement at variance with any of the terms or provisions of this agreement of sale shall be binding upon either us or you unless contained in a written document agreed to in writing by each of us. Country of domicile This website is governed by the laws of South Africa and crittersandcomics.co.za chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature, Wahlberg Eagle 58B, Rooihuiskraal North Ext 18, 0157 Variation crittersandcomics.co.za may, in its sole discretion, change this agreement or any part thereof at any time without notice.
